These Terms of Service ("Terms") are an agreement between you and Caravona Systems ("we," "us," or "our") governing your use of the DuctPrint application (the "app"). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.
1. License to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices that you own or control, for your own personal or business use, in accordance with these Terms and the Apple App Store terms. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app, except to the extent that restriction is not permitted by law.
2. The app is a planning aid — you are responsible for verifying your work
Important. DuctPrint is a tool for visually laying out ductwork and producing drawings, measurements, and takeoffs. It is intended to help you plan and communicate a duct run. It is not engineering software, and it does not certify code compliance, structural adequacy, airflow performance, or fitting suitability.
You are solely responsible for reviewing and verifying all sizes, measurements, quantities, takeoffs, fabrication details, and layouts before ordering material, fabricating, or installing any ductwork. All output from the app should be checked against your project requirements, applicable building and mechanical codes, manufacturer specifications, and sound trade practice. DuctPrint is not a substitute for professional judgment or a licensed engineer where one is required.
3. No warranty
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any calculation, measurement, or takeoff it produces is accurate or complete for your intended use.
4. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, materials, labor, or business, arising out of or related to your use of (or inability to use) the app — including any errors in measurements, sizes, takeoffs, or drawings, or any decisions made in reliance on them. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the app, if any.
5. Your content
Any drawings, layouts, and files you create in the app are yours. As described in our Privacy Policy, these are stored on your device; we do not claim ownership of them and do not access them.
6. Intellectual property
The app, including its design, code, graphics, and the DuctPrint name and logo, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
7. Apple App Store terms
The app is licensed, not sold, to you, and your use is also subject to the Apple Media Services Terms and Conditions, including the standard Licensed Application End User License Agreement (EULA). You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
8. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the app after changes take effect means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of Kentucky, United States, without regard to its conflict-of-laws rules, except where the Apple App Store terms provide otherwise.
